Special emergency.

HONG KONG AND YAUMATI FERRY COMPANY (SERVICES)

of the terms and conditions specified in this Schedule, permit continuance of the concession for a third and final term of five years from the expiration of the last preceding term of five years and subject to the said terms and conditions, with the exception of any further right of renewal and so that the total term of the concession shall not extend beyond 31st December, 1979.

20. Nothwithstanding anything herein contained, in the event at any time of any special emergency, the Governor in Council being the sole judge of the occasion and duration of such emer- gency, the Governor in Council may direct that the Government shall take over the ferry services and continue the same, with or without modification, or suspend the same, as the Governor in Council shall see fit until the emergency no longer exists. The amount (if any) due to the Company consequent upon any such order as aforesaid shall in the absence of agreement be determined by arbitration.
